The European Court of Justice is to decide whether the provisions of the EU-Canada FTA on investment protection are tenable in within the ambit of EU law.
On Tuesday, Advocate General Yves Bot recommended to the European Court of Justice that the EU-Canada free trade deal’s provisions on investment protection are in line with EU law.
If the European Court of Justice subscribes to the views of the senior adviser of the court, it would be a major relief for proponents of the trade agreement, which came into force on a provisional basis in September 2017.
It is to be noted that judges are not bound by the opinions of advocate generals; they however tend to follow them in the majority of cases.
