Mishcon de Reya playing a pivotal role in Britain’s history.
Mishcon de Reya a law firm has started a legal action demanding that the British government first win legislative approval before triggering article 50 of the Lisbon Treaty, which will initiate its divorce from the European Union.
According to the London based law firm, Brexit will need an Act of Parliament before it can invoke Article 50, which is the trigger for formal negotiations on exiting the bloc which Britain joined in 1973.
Mishcon de Reya said its legal action is on behalf of a group of clients, it however did not identify them. However according to the BBC, their clients consist of academics and a group of business people.
The London based law firm has disputed the government’s view that following the 52-48 results of the referendum in favour of Britain leaving the European Union on June 23, the government has sufficient legal authority to invoke Article 50 of the Lisbon Treaty without routing the decision through parliament.
“The outcome of the Referendum itself is not legally binding and for the current or future Prime Minister to invoke Article 50 without the approval of Parliament is unlawful,” said Kasra Nouroozi, a partner Mishcon de Reya, in the statement.
Mishcon de Reya has been in correspondence with government lawyers since June 27 in order to re-assure its clients that the government will respect the sovereignty of the British parliament.
Earlier, outgoing Prime Minister, David Cameron has said he will step down leaving his successor to tread the minefield of triggering Article 50.
However, Theresa May, who is currently in the lead in the Conservative Party’s leadership race for becoming Britain’s Prime Minister, the will of the people have been expressed – “Brexit means Brexit”.
